Since no side's insights can really be deemed to be the correct path to follow in such a questionable situation then an agreement must be met between the two which allows both sides to follow whichever path they choose to. So, simply put I believe that viability was such an important part of the case because it alleviated pressure on both sides instead of forcing the court to favor one particular party of the debate.
